Terms & Conditions
1. Welcome
Thank you for trusting in Athletic Evolution (“AE,” “we,” “our,” “us,” “the club”) to help you with your health and fitness goals. Please thoroughly read these Terms and Conditions before becoming a member, purchasing a drop-in pass, booking personal training, or using our website athleticevolution.ca.
By becoming a member, purchasing a pass, booking personal training, or using our website, you agree to be bound by these Terms. If you do not agree, you may not use our services.
2. Facility Access & Hours
Your membership at Athletic Evolution allows you access to the facility from 4:50 AM to 10:00 PM every day. Our hours are subject to change at our discretion.
Staffed hours are 9:00 AM to 4:00 PM, Monday to Friday. Outside staffed hours, members enter at their own risk and accept enhanced responsibility for their safety.
We prohibit all members from using their key fob or digital entry credentials to allow access to another person into the facility. This includes “tailgating” — allowing others to enter on your access. Violation may result in immediate membership termination.
3. Emergency Response
You acknowledge that if you are injured, become unconscious, suffer a stroke or heart attack, there will be First-Aid/CPR trained staff members in the facility during staffed hours who will do their best to assist you but are not responsible for your safety.
During unstaffed hours, if you witness or are subject to an emergency, please call 911 immediately.
4. Assumption of Risk
Because physical exercise can be strenuous and subject to the risk of serious injury, the club urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity.
You (each member, guest, or participant) agree that if you engage in any physical exercise or activity, or use any club amenity on the premises or off-premises including any sponsored club event, you do so ENTIRELY AT YOUR OWN RISK.
You agree that you are voluntarily participating in the use of this facility AND ASSUME ALL RISKS of injury, illness, or death. We are also not responsible for the loss of any of your personal property.
5. Waiver and Release of Liability
This waiver and release of liability includes without limitation, all injuries which may occur, regardless of negligence, as a result of:
- (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction
- (b) the sudden and unforeseen malfunctioning of any equipment, and
- (c) your slipping and/or falling while in the club, or on the club premises, including adjacent parking areas and sidewalks.
You acknowledge that you have read carefully this “waiver and release” and fully understand that it is a RELEASE OF LIABILITY. You expressly agree to release and discharge the club, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring legal action against the club for negligence, personal injury, or property damage.
6. Club Policies and Membership Guidelines
